User Agreement

Please review these terms carefully.  The User Agreement outlined below (referred to as the “User Agreement” or this “Agreement”) form a legal agreement between you and Call Box BPO (Private) Limited referred to as “CBB”.  To use CBB’s services “Service”, you must agree to these User Agreement.  By utilizing the Company’s services, you acknowledge and agree to be bound by the User Agreement, along with any future updates or addendum published at www.callboxbpo.com.

USER AGREEMENT

  1. Universal Services
  2. Call Box BPO (Private) Limited is a company duly registered with the Securities and Exchange Commission of Pakistan (SECP) and licensed by the Pakistan Software Export Board (PSEB), operating under the regulatory laws of the Democratic Republic of Pakistan;
  3. The company primarily provides business process outsourcing (BPO) services, including 24/7 customer support, digital marketing, and human resources management;
  4. Call Box BPO (Private) Limited operates in full compliance with the Pakistan Electronic Crimes Act (PECA) and all other applicable data privacy and cybercrime laws in Pakistan; and

  6. Adaption
  7. By using the services of CBB, you agree that you have read, understood, accepted, and agreed to the User Agreement; and
  8. You also agree to the representations made by you as indicated below. If you do not agree with the User Agreement or do not comply with them, please discontinue using the service.
  9. Adjustments to User Agreement

The Company reserves the right to modify, vary and change the User Agreement or its policies relating to it at any time as it deems fit.  Such modifications, variations and or changes to the User Agreement or its policies shall be effective upon the posting of an updated version at www.callboxbpo.com.

  1. Utilization, Claims and Obligations
  2. By using the Service, you expressly represent and warrant that you are legally entitled to accept and agree to the User Agreement. By using the Service, you further represent and warrant that you have the right, authority and capacity to use the Service and to abide by the User Agreement.  You further confirm that all the information which you provide shall be true and accurate.  Your use of the Service is for your own sole and personal use.  When using the Service, you agree to comply with all applicable laws whether in your home nation or otherwise in the country, state and city in which you are present while using the Service; and
  3. By using the Service, you agree that:
  4. You will only use the Service for lawful purposes and for the purpose for which it is intended to be used;
  5. You will not use the website for illegal purposes or for purposes other than obtaining the Service;
  • You shall not intentionally or unintentionally cause or attempt to cause damage to any third party;
  1. You will not disrupt access to the Company’s website, modify the website, use it to transmit computer viruses, hacking attacks, computer worms, etc. or commit activities that may be found to be a crime;
  2. You will not copy, or distribute this site’s content without written permission from the Company, not impersonate Company or any person or entity or falsely misrepresent your affiliation with Company, or with third parties;

 

  1. You agree to provide accurate, current and complete information as required for the Service and undertake the responsibility to maintain and update your information in a timely manner to keep it accurate, current and complete at all times;
  • You agree that the Company may rely on your information as accurate, current and complete. You acknowledge that if your information is untrue, inaccurate, not current or incomplete in any respect, the Company has the right but not the obligation to terminate its Service and your use of the Service at any time with or without notice;
  • You agree that the Service is provided on a reasonable effort basis;
  1. You agree that your use of the Service will be subject to the Company’s Privacy Policy as may be amended from time to time; and
  2. You agree to assume full responsibility and liability for all loss or damage suffered by yourself, the Company or any third party as a result of any breach of the User Agreement.
  3. Privacy Policy, Information Collection, Storage and Security
  4. CBB reserves the right to collect anonymous information about your usage of our services. This includes but is not limited to location data, usage patterns, cookies and information typed into fields.  You consent that data gathered from or submitted by you can be used by CBB for improving its services and commercial purposes.  Any information that we collect is anonymous and does not include personally identifying information;
  5. CBB is committed to handling personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA). As a Canadian customer, you have the right to access, correct or delete any of your personal data.  For inquiries regarding your data, please contact our Privacy Officer at [email protected];
  6. Personal data will be retained only for as long as necessary to fulfill the purposes for which it was collected or as required by law. Once this period is over, the data will be securely disposed-off;
  7. If you are a California resident, you have the right under the California Consumer Privacy Act (CCPA) to request access to your personal data, delete it, and opt out of its sale. CBB does not sell your personal data, but if you wish to exercise your rights under the CCPA, please email us at [email protected].  We will respond to your request within 45 days;
  8. Under the General Data Protection Regulation (GDPR), European Union residents have the right to request access, rectification, erasure, restriction of processing and portability of their personal data. You also have the right to object to the processing of your data and to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.  For any data-related requests, please contact our Data Protection Officer (DPO) at [email protected];
  9. We are committed to ensuring your data is processed lawfully, fairly and transparently. Personal data collected may be transferred to and processed in countries outside the EEA, including Pakistan, where data protection laws may differ;
  10. You agree and consent to the Company using and processing your personal data for the purposes and in the manner as identified hereunder;
  11. For the purposes of this Agreement, “Personal Data” means information about you, from which you are identifiable, including but not limited to your name, gender, date of birth, and email address;
  12. The provision of your personal data is voluntary, however, if you do not provide the Company your personal data, your request for the Service may be incomplete and the Company will not be able to process your personal data for the purposes outlined below and may cause the Company to be unable to allow you to use the Service; and
  13. By submitting your information to the Company, you consent to the use of that information.
  14. Intellectual Property and Proprietary Claims
  15. All information, content, designs, branding, methods and features displayed on our website are the copyright and intellectual property of CBB unless otherwise noted; and
  16. You may not collect, save, copy, re-share, publish, or re-use any of this copyrighted material, in original or in modified form, unless given express written consent by CBB.
  17. Web Accessibility and WCAG Compliance

  2. THE USE OF THE SERVICE IS AT YOUR OWN RISK. THE COMPANY’S SERVICE IS PROVIDED “AS IS”.  YOU UNDERSTAND AND AGREE THAT CBB SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES.  SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM THE USE OF OR INABILITY TO USE THE SERVICE, RELIANCE ON THE SERVICE, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICE;
  3. THE COMPANY MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, AVAILABILITY, ACCURACY OR COMPLETENESS OF THE SERVICE. THE COMPANY DOES NOT REPRESENT OR WARRANT THAT (A) THE USE OF THE SERVICE WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE, (B) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (C) THE QUALITY OF ANY SERVICE, INFORMATION, OR OTHER MATERIALS OBTAINED BY YOU THROUGH THE COMPANY’S WEBSITE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (D) ERRORS OR DEFECTS IN THE WEBSITE WILL BE CORRECTED, OR (E) THE WEBSITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON – INFRINGEMENT OF THIRD PARTY RIGHTS, ARE HEREBY EXCLUDED AND DISCLAIMED TO THE HIGHEST AND MAXIMUM EXTENT;
  4. THE COMPANY ensures that all promotional and advertising content on our website complies with the Federal Trade Commission (FTC) guidelines for truth-in-advertising. We strive to present accurate and non-deceptive information in all representations of our services;
  5. YOU ACKNOWLEDGE AND AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE SERVICE, AND ANY THIRD-PARTY SERVICE OR PRODUCTS REMAIN SOLELY AND ABSOLUTELY WITH YOU AND YOU SHALL HAVE NO RECOURSE WHATSOEVER TO THE COMPANY;
  6. THE SERVICE MAY BE SUBJECT TO LIMITATIONS, DELAYS, AND OTHER PROBLEMS INHERENT IN THE USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS INCLUDING THE DEVICE USED BY YOU BEING FAULTY, NOT CONNECTED, OUT OF RANGE, SWITCHED OFF OR NOT FUNCTIONING. THE COMPANY IS NOT RESPONSIBLE FOR ANY DELAYS, DELIVERY FAILURES, DAMAGES OR LOSSES RESULTING FROM SUCH INTERNET DELAYS, AND/OR CONNECTIVITY PROBLEMS; and
  7. WITHOUT LIMITING THE FOREGOING, THE COMPANY SHALL NOT BE LIABLE FOR ANY INJURY TO YOUR PERSON OR LOSS OF LIFE OR PROPERTY OR DELAY OF YOUR JOURNEY FOR ANY REASON WHICH MAY INCLUDE BUT NOT LIMITED TO AN ACT OF GOD INCLUDING BUT NOT LIMITED TO NATURAL DISASTERS, TYPHOONS OR FLOOD, AN ACT OF WAR, CIVIL DISRUPTIONS OR STRIKES OR THE ANTICIPATION OF THE SAME, CRIMINAL ACTS OR OMISSIONS OF THIRD PARTIES, INDUSTRIAL ACTIONS, SEIZURE UNDER LEGAL PROCESS, NATIONAL OR LOCAL DISRUPTIONS TO AIR, GROUND OR WATER TRANSPORTATION NETWORKS OR BREAKDOWN IN COMMUNICATION OR INFORMATION SYSTEMS.
  8. Promotions and Ads
  9. In accordance with Canada’s Anti-Spam Legislation (CASL), CBB will only send promotional emails to users who have provided express or implied consent. You can unsubscribe from our email communications at any time by clicking the “unsubscribe” link in the email;
  10. In compliance with the CAN-SPAM Act, all commercial emails from CBB will contain an accurate subject line, a physical postal address and a clear method to opt out of future emails. If you no longer wish to receive emails from us, please use the “unsubscribe” link included in the email;
  11. CBB reserves the right to display advertisements on its website and related services;
  12. There may be links to third party websites that may be found all throughout Company’s website. You are recommended to examine the privacy statements and/or User Agreement of these websites;
  13. CBB uses cookies and other tracking technologies to enhance your browsing experience and improve our services. By continuing to use our website, you agree to the use of cookies as described in our Cookies Policy.  You can manage your cookie preferences or disable cookies via your browser settings, but doing so may affect the functionality of our website; and

  15. Notifications

The Company may provide notice through a general announcement on the website or by sending an email to the address on record.  Such notice will be considered given one hour after the email is sent.  You may provide notice to the Company, which will be deemed received when the Company acknowledges it, by sending a letter via courier or registered mail using the contact details provided on the website.

  1. Security Commitments

CBB is committed to maintaining the security of your personal information.  We implement appropriate technical and organizational measures to protect your data against unauthorized access, accidental loss, destruction, or alteration.  However, no data transmission over the internet or data storage system can be 100% secure.  If you have concerns about the security of your data, please contact our DPO immediately.

  1. Delegation of Duties
  2. This Agreement, as defined by the User Agreement and modified from time to time, cannot be assigned by you without the prior written consent of the Company. However, the Company may assign it without your consent.  Any attempt to assign the Agreement by you in violation of this section shall be considered void; and
  3. In compliance with data protection regulations, if CBB outsources any data processing to third-party vendors, we ensure that these vendors adhere to GDPR, PIPEDA and other applicable laws. Data sharing with third-party service providers is limited to the minimum required to perform services on our behalf and such providers are contractually obligated to keep personal data secure.
  4. Call Box BPO Compliance (GDPR, CCPA, PIPEDA) Rights
  5. Under various global privacy laws, including GDPR, CCPA and PIPEDA, CBB reserves several rights regarding our personal data, which include the following:
    1. Right to Access: You can request details about the personal data we collect about you;
    2. Right to Rectification: You can request corrections to inaccurate or incomplete personal data;
  • Right to Erasure (‘Right to be Forgotten’): You can request the deletion of your personal data under certain circumstances;
  1. Right to Data Portability: You can request to receive the personal data we hold about you in a structured, machine-readable format;
  2. Right to Object: You can object to the processing of your personal data; and
  3. Right to Withdraw Consent: You can withdraw your consent for data processing at any time without affecting the legality of processing based on consent before withdrawal.

  1. Detachability

In the event that any provision hereof is found invalid or unenforceable, the remainder of the User Agreement shall remain valid and enforceable.

  1. Discharge

Failure of Company to exercise or enforce any of the provisions herein shall not constitute a waiver of such right.

  1. Governance

This User Agreement shall be construed in accordance with, and governed in all respects by, the laws of Democratic Republic of Pakistan without regard to conflicts of law principles.
